Background Of The Mandatory Vaccination Rule

For those who are interested in this rules history, this new measure had been announced in mid-August just before a useless election was called in the middle of a pandemic.

Thats really all the government said on the topic: Mandatory vaccination for all flights before the end of October.

On October 1, then Health Minister Patty Hajdu reconfirmed in a press conference that the end of October timeline still stood, but no details were provided.

On October 6, most details about this measure were officially announced, including the grace period.

On October 29, a few more details about exemptions were confirmed in another press conference.

And finally, the measure came into effect on October 30 at 3 AM .

On November 30, the grace period ended quietly without any other announcements.

Since then nothing has changed.

Exemptions And Exceptions To The Proclamation 10294 Vaccine Requirement

Proclamation Section 3 contains a number of important exceptions for certain individuals who would otherwise be subject to the full vaccine requirement. Nonimmigrants who do not meet the definition of fully vaccinated but who are traveling by air to the United States under one of the Section 3 exceptions are referred to as Excepted Covered Individuals in the CDC Amended Order Implementing Proclamation on Safe Resumption of Global Travel During the COVID-19 Pandemic. In general see CDC Technical Instructions: Procedures for Confirming Documentation of Excepted Covered Individuals Who Do Not Present Proof of Being Fully Vaccinated.

In an liaison meeting with the Department of State, the American Immigration Lawyers Association ‘s DOS Liaison Committee asked: “To what extent, if at all, are consular posts and/or the broader DOS engaged in assessing whether an individual is eligible for an exception to the new vaccine and testing requirements?” DOS responded: “Consular sections’ role in the process is to ensure that an individual’s request for an exception is filled out in full, and to transmit to CDC the completed requests.” See Department of State/AILA Liaison Committee Meeting, January 20, 2022, AILA Doc. No. 22011002.

The CDC order provides that individuals who enter the United States under one of the order’s exceptions must attest that they will take certain post-arrival actions, that, depending on the exception, could include:

Why The Requirement Is Not Based On Science

U.S. to open Canada, Mexico borders for vaccinated visitors

If you care to know, this requirement was not implemented for safety or based on science.

Because clearly, the government doesnt really believe that having unvaccinated travelers on a plane is risky: All foreigners are allowed to sit on planes to Canada and planes departing from Canada without being vaccinated .

Yes, transits in Canada are wide open.

And without any requirement. Since the beginning of the pandemic. That has not changed.

All passengers transiting through Canada are exempt from this new requirement to be fully vaccinated .

If flying while unvaccinated was so dangerous, that simply would not be allowed.

But also, for safety, a molecular test could easily be accepted as an alternative. Because a traveler who is unvaccinated but tested is possibly less risky than a traveler who is vaccinated .

Unvaccinated travelers who enter Canada have been tested within 72 hours and are retested upon arrival: 1% test positive according to government data. It is not unreasonable to believe that vaccinated travelers could be 1% positive as well since they are not tested. And thus be just as much of a risk than unvaccinated travelers .

In short, maybe the goal is not really to protect us but to encourage vaccination and/or to punish the unvaccinated.

That could be debated . But the government should at least be honest and stop pretending its for safety if it keeps letting foreigners onboard the same planes without being vaccinated or tested!
